Terms of service
Trading Terms set out the terms and conditions from which you may purchase products via the Peninsula Safety & Workwear web site, telephone, or email. Please read the following terms carefully before placing your order or purchasing. By completing the online order form or by ordering via telephone you the Customer agrees to be bound by the terms and conditions listed below.
Goods displayed on the Peninsula Safety & Workwear website are available for purchase subject to availability and stock levels online, via email over the telephone and in our store.
The Customer must use the online order system to place an order for Goods via the internet. This is classified as an Online Order. The Customer warrants that all information and data provided by him/her in the online order is accurate, complete, and up to date. Please fill in all fields in the customer details section such as phone number & email etc in case we need to contact you. The Customer will promptly advise Peninsula Safety & Workwear if there is any change to this information or data provided as soon as possible.
After an Online Order has been submitted or placed the Customer will be contacted via text or email to confirm that the order has been received. Once Fulfilled a message is sent to say order is packed and once Courier has collected a message will be sent with tracking information within a reasonable time after order has been placed.
The Customer is responsible for any costs associated with accessing the Peninsula Safety & Workwear website and placing Online Orders including any internet service provider fees and for all telephone call charges if ordering over the telephone or mobile.
Peninsula Safety & Workwear may withhold supply of the Goods to the Customer where Peninsula Safety & Workwear has insufficient Goods or stock levels to supply and fulfil the order, the Goods ordered have been discontinued or if the Customer has an account with Peninsula Safety & Workwear and that account is overdue. A full refund of any amounts paid by the Customer will be made if the supply of Goods is withheld.
Prices listed are in Australian dollars and are subject to change but will not affect orders placed prior to a change or changes taking effect.
All prices include GST.
Special pricing or Sale prices are as shown on the website until sale or promotion has finished. No further discounts will apply.
Goods ordered are charged at the price applicable at the time the order is submitted. Upon delivery of the Goods, Peninsula Safety & Workwear will provide a tax invoice specifying the total price for the Goods including delivery. If another copy is required, please contact us to email you a digital copy.
Customers may set up an account with Peninsula Safety & Workwear by completing and submitting to Peninsula Safety & Workwear an application for a 30-day Credit Account. Peninsula Safety & Workwear’s General Credit Terms and Conditions apply.
Peninsula Safety & Workwear accepts the following payment methods for Online Orders and telephone orders: credit card (Visa & Mastercard) cheque (personal or bank). Cheque payments require 5 Business Days to clear before Goods are dispatched to the Customer. Cash payments are accepted in Peninsula Safety & Workwear stores only.
Property in the Goods does not pass until the Customer has paid all monies owing to Peninsula Safety & Workwear in full. Risk in the Products passes to the Customer at the time the Goods are delivered to the Delivery Address.
All delivery costs will be charged to the Customer.
Delivery can take up to 5 -10 days. If the item needs to be ordered in, it may take up to 15-20 days.
Anyone at the Delivery Address who receives the Goods shall be presumed by Peninsula Safety & Workwear to be authorized to receive the Goods.
If there is no-one at the Delivery Address or no-one of appropriate age to receive the Order when the Order is delivered, Peninsula Safety & Workwear may retain possession of the Goods and charge an additional delivery fee when attempting to redeliver the Goods.
If available, the Customer or a nominated person may collect the goods from Peninsula Safety & Workwear’s Store. If so, Peninsula Safety & Workwear will require some form of government issued photo ID such as a drivers license.
Warranties and Returns
All Peninsula Safety & Workwear Goods carry the manufacturer's warranty where applicable.
Except where otherwise stated and to the extent permitted by Australian Consumer Laws, Peninsula Safety & Workwear excludes all warranties in respect of the Goods.
Goods incorrectly ordered or unused that are no longer needed by the Customer and are unopened may be returned to Peninsula Safety & Workwear within 14 days and at Peninsula Safety & Workwear’s absolute discretion.
A copy of the Peninsula Safety & Workwear invoice or proof of purchase must be attached to all returned Goods.
Before returning Goods, the Customer needs to contact Peninsula Safety & Workwear too confirm the correct process.
Goods to be returned at the customer’s cost.
Refunds will be made in the same way as original payment for the Goods.
Peninsula Safety & Workwear Gift Card Conditions
Peninsula Safety & Workwear gift card will expire 24 months from the date of issue.
Unused balance on expiry of Peninsula Safety & Workwear gift cards will not be refunded or credited.
Cash will not be given for any unused balance on Peninsula Safety & Workwear gift cards.
Treat Peninsula Safety & Workwear gift cards like cash. Lost or stolen cards will not be replaced.
Peninsula Safety & Workwear gift cards are to be used for purchase of goods and services at Peninsula Safety & Workwear only. Change will not be given, and Peninsula Safety & Workwear gift cards are not redeemable for cash or payment of credit or store 30 Day Credit accounts.
Peninsula Safety & Workwear takes reasonable care in supplying personal protective equipment and other safety equipment based on information provided by the Customer. However, Peninsula Safety & Workwear is not responsible or liable for any loss or damage caused to person or property as a result of the Customer's failure to seek professional advice from appropriate authorities or safety specialists before making a purchase from Peninsula Safety & Workwear.
Peninsula Safety & Workwear is not liable for any loss or damage whatsoever suffered by the Customer as a result of any act, omission or statement made by Peninsula Safety & Workwear, its employees, contractors or agents whether negligent or not, or as a result of a delay or inability to deliver the Goods, except that nothing in these Terms limits any liability imposed by any statute, including, without limitation the Australian Consumer Law, unless or to the extent that it is lawful to do so.
The Customer indemnifies Peninsula Safety & Workwear against all loss, liability, cost (including legal costs on a full indemnity basis) and expense incurred by Peninsula Safety & Workwear in connection with any act or omission of the Customer including, but not limited to, negligence of the Customer or any unauthorized representation made or warranty given by the Customer in connection with the Goods; or as a result of any claim made or action brought in connection with the Goods or their use other than a claim or action brought by the Customer under these Terms or a condition or warranty implied by law which is not excluded by these Terms.
The entire risk arising out of the use or performance of the website remains with the Customer. To the extent permitted by law, the Customer releases and discharges Peninsula Safety & Workwear and its related bodies corporate from all forms of direct, special, indirect, or consequential loss or damage (including loss of profits and loss of data) arising out of or in connection with Peninsula Safety & Workwear or these Terms.
Intellectual Property Rights
The Customer acknowledges that Peninsula Safety & Workwear or its related bodies corporate own or are licensed to use all intellectual property rights in the Peninsula Safety & Workwear web site (including, but not limited to, any images, photographs or text which appear on the web site). The Customer agrees that he/she will make no representation to the contrary, and that he/she will not use or copy Peninsula Safety & Workwear’s website or content in any manner which is inconsistent with the rights of the owner or licensee of such intellectual property rights.
The Customer acknowledges that any trademarks or logos which appear on the Peninsula Safety & Workwear web site are owned by or licensed to Peninsula Safety & Workwear or its related bodies corporate, and that the Customer must not do anything to prejudice the rights of the trademark owner or licensee to such trademarks or logos.
Provisions are severable
Each clause and subclause of these Terms is separate and independent. If any clause or subclause is found to be invalid or ineffective, the other clauses or subclauses will not be adversely affected.
Applications of law
These Terms are subject to the laws of Victoria and the parties submit to the jurisdiction of the Courts of the State of Victoria.
Changes to terms
Peninsula Safety & Workwear reserves the right to amend these Terms from time to time as required. Amended Terms come into effect from the time they are posted on the website. You should review this page regularly to ensure that you are aware of any changes to the terms prior to placing an order.
Effect of other terms
These Terms are in no way affected by any other express or implied terms contained in any terms of sale issued by a business Customer in relation to the sale of the Goods.
Where these Terms are inconsistent with the General Credit Terms and Conditions in respect of a customer’s account with Peninsula Safety & Workwear, the General Credit Terms and Conditions prevail.
